Pets Best Two Peas in a PAWd Contest Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: Pets Best Two Peas in a PAWd Contest (the “Contest”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of Pets Best Insurance Services, LLC, Merkle Inc., and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor: Pets Best Insurance Services, LLC, 10840 Ballantyne Commons Parkway, Charlotte, NC 28277. Administrator: Merkle Inc., 3000 Town Center, Suite 2100, Southfield, MI 48075.

3. Agreement to Official Rules: Participation in this Contest constitutes entrant’s full and unconditional agreement to these Official Rules. Sponsor’s and Administrator’s decisions are final and binding in all matters related to this Contest. Winning the prize is contingent upon fulfilling all requirements set forth herein.

4. Timing: The Contest begins on April 15, 2024 at 12:00 a.m. Eastern Time ("ET") and ends on April 26, 2024 at 11:59 p.m. ET (the "Contest Period"). Instagram’s servers are the official time-keeping devices for the Contest.

5. How to Enter:
Participation Requirements: To participate, you will need to have a personal and public Instagram account. Creating an account is free but is subject to the applicable terms and conditions. If entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.

Entry Requirements: During the Contest Period, locate the “Contest Post” on Instagram (posted at approximately 12:00 a.m. ET on April 15, 2024) advertising this Contest and take the following actions to receive an entry:

Like the Contest Post;
Follow @petsbest on Instagram;
Post an in-feed video (Instagram Story will not be deemed an entry) that is no longer than 1 minute of your dog or cat (herein your “Pet”) that shows what makes your Pet the best companion for you; and
Include @petsbest and #TwoPeasinaPAWdContest in the original caption. Note: Instagram posts where the hashtag is included in a comment rather than the caption of the original post will not be deemed entries.
Your account settings must remain public during the Contest Period and until the prize is awarded (as described in Section 8); and
You must not change your Instagram handle during the Contest Period and until the prize is awarded (as described in Section 8).

By posting on Instagram, (herein your “Submission”), you agree that it conforms to the guidelines, permissions, and content restrictions below and that Sponsor, in its sole discretion, may disqualify you if it believes that it fails to conform. Where your Submission meets all requirements, your Submission will be deemed one (1) Contest entry.

Guidelines:

The Submission must meet Instagram’s format and size requirements; and
The Submission must be in English.

Permissions: Entrant must not include any other recognizable individuals in the Submission, unless these individuals are immediate family members (parent, sibling, spouse or children) who have expressly agreed to allow you to use their names and likenesses in the Submission and to grant the rights set forth herein. Minors may only be included in the Submission if entrant is their parent or legal guardian. If requested, entrant must be able to provide such permissions or proof in a form acceptable to Sponsor.

Content Restrictions for your Entry:

The Submission must be your original work;
The Submission must not convey any claims of Sponsor’s products or services that would be deemed unsubstantiated or deceptive if made by Sponsor;
The Submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity, or intellectual property rights, or that constitutes copyright infringement

Accordingly, Submission must not contain brand names or trademarks other than those owned by Sponsor; and
Submission must not contain content created by a third party, such as music, images or artwork;

The Submission must not disparage Sponsor, or any other person or party;
The Submission must not promote, display or reference violence against, abuse of or any unsafe activity with your Pet;
Submission must not promote or reference alcohol, illegal drugs, marijuana, tobacco, or firearms/weapons, any activities that are or appear to be dangerous, or any political agenda;
The Submission must not contain material that is inappropriate, offensive, indecent, obscene, sexually explicit, tortious, defamatory, slanderous or libelous;
The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; and
The Submission must not contain material that is unlawful, in violation of, or contrary to the laws or regulations in any state where Submission is created.

Limit: Each entrant may upload five (5) Submissions during the Contest Period. Each Submission must be unique to qualify as an entry. Submissions received from any person in excess of the stated limit will be void. Submissions generated by script, macro or other automated means are void. Multiple entrants are not permitted to share the same Instagram account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different Instagram accounts, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. In the event of a dispute as to the identity of an entrant, Sponsor and Administrator will rely on the information associated with entrant's Instagram account used to enter the Contest. If additional information provided by entrant to claim the prize is inconsistent with the Instagram account used to enter, Sponsor and/or Administrator may disqualify such entrant and such disqualification may result in the forfeiture of any prizes won. Sponsor, in its discretion, may request additional documentation from entrant to confirm entrant’s identity.

6. Sponsor's Use of Submissions: Posting a Submission constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Submission.

7. Winner Determination: One (1) winner will be determined after the Contest Period concludes. A panel of qualified judges, determined by Sponsor in its sole discretion, will select the one (1) entrant with the highest-scoring Submission based on the following criteria (“Judging Criteria”):

Quality of Submission (34%);
Fit to Contest Theme (33%); and
Creativity/Originality (33%)

In the event of a tie, the entrant whose Submission received the highest score for "Quality of Submission," as determined by the qualified judges in their sole discretion, will be deemed the applicable potential winner from amongst the tied entrants. Sponsor reserves the right not to select a winner if, in its sole discretion, it does not receive any eligible and qualified Submissions. Sponsor will not disclose judging scores.

8. Winner Requirements: On or around May 14, 2024, the potential winner will be notified by @petsbest via private message on Instagram and will be directed to a secure online claim form and asked provide their full name, mailing address, email address, and date of birth to confirm eligibility and for prize fulfillment purposes within two (2) days of the date notice or attempted notice is sent to claim the prize. The potential winner (or parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return a Declaration of Compliance, Liability Waiver and, where not prohibited, a Publicity Release ("Declaration") which must be received by Administrator, within five (5) days of the date notice or attempted notice is sent, in order to claim the prize. If the potential winner of the prize cannot be contacted, fails to sign and return the Declaration or provide any other requested information, within the required time period (if applicable), or the prize is returned as undeliverable, the potential winner forfeits the prize. If a potential winner is disqualified for any reason, the prize may be awarded to a runner-up, if any, in Sponsor’s sole discretion. Only three (3) alternate winners may be determined, after which the prize will remain un-awarded.

9. Prize: ONE (1) GRAND PRIZE: A $1,000 check made out to the winner; one (1) GoPro HERO12 Black camera; and one (1) of the following GoPro camera accessories: Fetch Dog Harness, Bite Mount, Shorty Mini Extension Pole + Tri-pod, or The Handler Floating Hand Grip. Winner will have the opportunity to select their preferred accessory during the winner confirmation process. If winner fails to provide preference to Sponsor, Sponsor will make a selection on behalf of the winner. Approximate Retail Value (“ARV”): $1,500.00 (may vary based on selected accessory).

Prize is non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize (or a component thereof) for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Prize will be fulfilled approximately 8-10 weeks after the end of the Contest.

10. Release: By receipt of any prize, the winner agrees to release and hold harmless the Sponsor, Instagram Inc., Meta Platforms Inc., Administrator, and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, third party claims involving the right to privacy, right of publicity, or intellectual property infringement arising out of participation in the Contest or receipt or use or misuse of any prize.

11. Publicity: Acceptance of any prize shall constitute and signify the winner’s agreement and consent that Sponsor and its designees may use the winner’s name, city, state, likeness, photo, including winner’s Instagram profile photo, Submission, and/or prize information in connection with the Contest for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.

12. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest if any fraud, technical failures, human error, any other factor impairs the integrity or proper functioning of the Contest, or any event or cause beyond Sponsor’s control (e.g. events such as natural calamities, national emergencies, widespread illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Contest, including but not limited to fulfillment of the prize(s), as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine the winner(s) from among all non-suspect, eligible Entries received up to time of such action using the judging procedure outlined above. Sponsor may also modify the prizes offered. In addition, Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

13. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of Submissions, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; (6) lost, late, unreceived, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Submissions or failure to receive Submissions due to limitation of third-party social network platforms or (7) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third-party use of any Submission.

14. Disputes: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

15. Severability:If the application of any provision of these Official Rules to any particular facts or circumstances shall for any reason be held to be invalid, illegal or unenforceable by a court, arbitration panel or other tribunal of competent jurisdiction, then (a) the validity, legality and enforceability of such provision as applied to any other particular facts or circumstances, and the other provisions of these Official Rules, shall not in any way be affected or impaired thereby; and (b) such provision shall be enforced to the maximum extent possible. In addition, if any provision contained in these Official Rules shall for any reason be held to be excessively broad as to duration, geographical scope, activity, or subject, it shall be construed by limiting and reducing it, so as to be enforceable to the extent compatible with applicable law.

2024 Petfort Music Festival Sweepstakes Official Rules

NO PURCHASE OR OBLIGATION NECESSARY TO WIN.

1. Eligibility: The 2024 Petfort Music Festival Sweepstakes (the “Sweepstakes”) is open to legal residents of the United States (including DC and other Territories), aged 18 or older as of the date of entry (“Eligible Entrants”). The following are not eligible to participate: employees and their families of Synchrony Bank, Pets Best Insurance Services, LLC (“Sponsor”), each of their affiliates, subsidiaries, advertising and promotion agencies and Sweepstakes Exhibitors. By entering, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Void where prohibited by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Sponsor reserves the right, at its sole discretion, to disqualify any entry if it concludes that the entrant has tampered with the entry process or the operation of the Sweepstakes or has acted in violation of the Official Rules or any applicable federal, state, or local laws or regulations.

2. Sweepstakes Period: Sweepstakes begins at 11:00 a.m. Mountain Time (“MT”) through 1:45 p.m. MT daily on 3/23/24 and 3/24/24 (the “Sweepstakes Period”) at the Tree Music Festival in Downtown Boise, ID (“Event”).

3. Sponsor: Pets Best Insurance Services, LLC, 965 Keller Rd. Altamonte Springs, FL 32714 (“Sponsor”).

4. Entry: To enter during the Sweepstakes Period, Eligible Entrants will be required to visit the Pets Best Petfort at the Event and write their name and email address on their raffle ticket, before placing in the ticket in the entry box provided (“Entry”). Limit one Entry per person during the entire Sweepstakes Period.

5. Random Drawing, Odds and Winner Notification: On or about 2:00 pm MT on March 23^rd and 24^th, 2024, Sponsor will conduct a random drawing to select three (3) winners and alternates, from among all eligible Entries received each day. Entries made on the first day will not carry over to the second day. Winners will be announced at approximately 2:15 pm MT at the Pets Best Petfort and will have 15 minutes to claim their prize in person as indicated or prize will be forfeited and an alternate winner selected and announced. Must be present to win. Approximate odds of winning are dependent upon the total number of eligible Entries received.

Drawing will be conducted and administered by Sponsor, whose decision is final on all matters relating to this Sweepstakes.

All potential winners are subject to verification by Sponsor. An Eligible Entrant is not a winner of any prize unless and until Eligible Entrant's eligibility has been verified and Eligible Entrant has been notified that verification is complete.

6. Prizes and Approximate Retail Values ("ARV") and Prize Fulfilment: Prizes are as follows: 6 Winners (3 per day) will be awarded two (2) Main Stage Festival passes for the day that the prize is won, either Saturday, March 23, 2024 or Sunday, March 24, 2024 (“Festival”) (ARV $120 each). ARV of all prizes is approximately $720. All applicable federal, state and local taxes are the responsibility of the winners. Passes must be picked up by winners at the Treefort box office in Julia Davis Park no later than 4 p.m. MST on the day that their name is announced. Must be present to win. In the event a winner already has passes for the Festival, they may transfer their winning passes to a friend or family member who is able to attend on March 23, 2024 or March 24, 2024, the day that the prize is won. Passes must then be redeemed at the Treefort Box Office in Julia Davis Park by 10 p.m. MST on the day the prize is won to attend Festival. Return of any email as undeliverable will result in disqualification and forfeiture of passes.

Prizes do not include transportation or accommodations to the Festival. No substitutions are permitted, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize of equal or greater value, if any prize becomes unavailable. No cash redemption of prizes, except at Sponsor’s sole discretion.

7. General Rules: By participating in the Sweepstakes, Eligible Entrants agree to be bound by these Official Rules and the decisions of the Sponsor. Acceptance of any prize constitutes permission for the Sponsor to use each winner's name and/or likeness for internal purposes without further compensation, for a winners list, unless prohibited by law. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Entries become the property of the Sponsor. The Sponsor and its agents are not responsible causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and randomly select the winners from all eligible Entries received prior to such cancellation. Sponsor is not responsible for typographical or other error in printing of the offer or administration of the Sweepstakes or announcement of the prizes.

8. Release: Sweepstakes Eligible Entrants release, defend, discharge, indemnify and hold harmless Sponsor and its parent, affiliates, subsidiaries, legal advisors, advertising and promotional agencies, and their respective officers, directors, employees, agents and representatives and all others associated with the development and execution of this Sweepstakes (collectively, the “Released Parties”) from any and all losses, costs, damages, injuries, claims, liabilities, and actions of any kind in connection with or participation in the Sweepstakes or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death or property damage, claims based on publicity rights, defamation, or invasion of privacy and claims based on or from any typographical, human or other error in the printing, offering, selection, operation or announcement of any Sweepstakes activity and/or Prize). Eligible Entrants agree that Released Parties shall have no responsibility or liability for human error; incorrect or inaccurate transcription of Entry or for any late, lost, incomplete, illegible, stolen, undelivered, misdirected Entries, or for printing, typographical, human or other error, including, without limitation, errors by any of the equipment or programming associated with or utilized in the Sweepstakes or which may occur in the printing, the offering or announcing of prizes, administration of the Sweepstakes or the processing of Entries of any kind relating to or in connection with this Sweepstakes.

Each Eligible Entrant further agrees to indemnify and hold harmless Released Parties from and against any and all liability resulting or arising from any Sweepstakes and to release all rights to bring any claim, action or proceeding against Released Parties and hereby acknowledge that Sponsor has neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a supplier of such prize that may be sent along with a prize. Sponsor is not responsible for the actions of Eligible Entrants in connection with any Sweepstakes, including Eligible Entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Sweepstakes.

Eligible Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Eligible Entrants acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

9. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW AND TO DISQUALIFY SUCH ENTRANT FROM THE SWEEPSTAKES. IN ADDITION, SPONSOR RESERVES THE RIGHT TO PERMANENTLY DISQUALIFY ANY PERSON IT BELIEVES HAS INTENTIONALLY VIOLATED THESE OFFICIAL RULES.

Each winner acknowledges that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce any winner to execute any document and winners acknowledge that they have not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by the Sponsor and its affiliates of any term of any document in a particular instance shall not be a waiver of such term for the future. Each winner agrees that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.

10. LIMITATION OF LIABILITY/GOVERNING LAW: EACH ELIGIBLE ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND (2) UNDER NO CIRCUMSTANCES WILL ELIGIBLE ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ELIGIBLE ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. My Vet’s the Best Official Rules 2018

1. Eligibility: My Vet’s the Best (“Contest”) is open only to U.S. legal residents who are at least eighteen (18) years of age as of January 1st, 2018. Employees of Pets Best Insurance, and its parent and affiliate companies as well as the immediate family (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, half-sister) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations and is void outside the United States and where prohibited. Sponsor reserves the right to verify eligibility qualification of winner. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor/Administrator: Pets Best Insurance Services, LLC. The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to Sponsor and not to Facebook. Any questions, comments or complaints regarding this Contest shall be directed to Sponsor and not Facebook.

3. Timing: This contest begins on November 1st, 2018, at 8 AM, Mountain Standard Time ("MST") and ends on December 1st, 2018, at 11 PM MST (the "Promotion Period"). Administrator's computer is the official time-keeping device for the Contest. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these “Official Rules” and the decisions of the Sponsor, including the interpretation of these Official Rules and its exercise of discretion, which will be final and binding in all respects. There is (1) one method of entry for this Contest.

4. How to Enter: During the Promotion Period, complete the online submission form at www.petsbest.com/forms/nominate-my-veterinarian. Stories may be duplicated in whole or in part on the Pets Best website (www.petsbest.com) and Facebook Page at the discretion of the Pets Best Marketing Team. Limit one (1) entry per pet. Information collected from entrant via the entry form will only be used to confirm nomination submission, notify the winner and notify nominated veterinarians and clinics. All entries become the property of Pets Best and will not be returned.

5. Winner Selection: Only once during 2018, in December, a Grand Prize Winner will be chosen. Five (5) finalists will be chosen by the Pets Best team then the voting will commence. The public will be invited to vote on one grand prize winner. The voting method and timeframe will be announced on the Pets Best Insurance Facebook page, Twitter page and website. The nominee with the most votes will be declared the winner.

6. Contest Prize: The pet owner who submitted the winning story will receive a $200 gift check. The veterinarian or veterinary hospital nominated in the winning story will receive $1,000 to be used toward the veterinary treatment of a stray animal/s, or toward the treatment of animal/s whose owner cannot afford to pay for necessary veterinary care (“Rainy Day” Fund). The winning veterinarian/veterinary hospital will be requested to report how the prize money was used; reports may be used in press releases or other marketing materials. In December 2018, one of the five (5) finalist veterinarians chosen via Facebook voting will be selected as the Grand Prize Winner.

Federal, state and local taxes on the prizes are solely the responsibility of the winner.

Entrants agree to abide by the terms of these Official Rules and by the decisions of Pets Best which are final and binding on all matters pertaining to this Promotion. This Promotion is governed by the laws of the United States. By entering the Promotion, participants release and hold harmless Pets Best Insurance Services, LLC, its parents, subsidiaries, affiliates, directors, officers, employees, sponsors and agents from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with this Promotion.

If notified winner is not eligible, forfeits prize or declines prize, there will be no alternate winner. Winning veterinarians/veterinary hospitals will be contacted via telephone. If Grand Prize Winner is not eligible, forfeits prize or declines prize, the nominated veterinarian with the second-most number of votes will become the Grand Prize Winner.

7. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, Facebook, Inc., Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.

8. Publicity: Except where prohibited, participation in the Contest constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions, image and/or biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in perpetuity, in any media known and hereafter discovered, worldwide and on the internet and World Wide Web, without notice, review or approval by the Winner and those acting under Sponsor’s authority.

9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, if it is possible. If the Contest, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Idaho; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
